FridgeWise Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the FridgeWise mobile application, website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you live in the United States, these Terms include an arbitration agreement and class-action waiver in Section 16.
1. Who we are

2. Eligibility
You must be 13 years or older and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
3. Scope of the Service
FridgeWise helps users track groceries, organize fridge/freezer/pantry inventory, estimate freshness timing, receive use-soon reminders, and manage grocery-related information.
The Service may include:
- Manual grocery tracking.
- Smart Import features for receipts, grocery photos, and shopping lists.
- Barcode scanning and product lookup.
- Freshness estimates and use-by date tracking.
- Notification preferences and freshness reminders.
- Free and premium features.
- Related websites, support channels, and account-management features.
We may update, add, or remove features over time.
4. Account & security
You are responsible for all activity that occurs under your account.
- Keep your contact information accurate.
- Do not share access codes or allow others to use your account.
- Notify us promptly if you suspect unauthorized access.
We are not liable for losses caused by someone else using your account with or without your knowledge.
5. Sign-in methods
You can sign in to the Service via:
- Email + verification code sent to your email address.
- Apple or Google authentication.
- Anonymous or guest access where available.
By using Apple or Google authentication, you authorize us to use those services to authenticate you and access the associated email address and provider user ID. We do not store your password for Apple or Google.
Anonymous or guest access may have limits. If you later create an account, certain guest data may become associated with that account.
6. Free & premium plans; subscriptions; in-app purchases
We may offer both free and paid versions of the Service.
Free users may have limits on:
- The number of active tracked items.
- The number of Smart Imports.
- Access to custom storage locations.
Premium users may receive:
- Unlimited tracked items.
- Unlimited Smart Imports.
- Custom storages.
Details about what each plan includes, plan limits, usage safeguards, and pricing are shown in the app and may change over time.
6.1. In-app purchases only
Currently, subscriptions and other in-app purchases are offered only through:
- Apple App Store.
- Google Play Store.
Billing, renewals, cancellation, and refunds for these purchases are handled by the platform where you made the purchase, under its own terms and policies. We do not process card payments directly.
6.2. Renewal, cancellation & refunds
- Subscriptions typically auto-renew until you cancel.
- You can manage or cancel your subscription in your Apple App Store or Google Play account settings.
- Refund requests for in-app purchases must be made through Apple or Google and are subject to their policies. We do not control whether a refund is granted by those platforms.
- We may offer free trials or introductory pricing from time to time; any such offers will be described in the app.
7. Freshness estimates, food safety & user responsibility
FridgeWise provides grocery tracking tools and freshness estimates. FridgeWise is not a food safety authority, medical provider, dietitian, or emergency service.
You understand and agree that:
- Freshness estimates are rough guidance only and may be inaccurate.
- Use-by timing may depend on the specific product, brand, package date, handling, storage temperature, contamination, whether the item was opened, and other factors FridgeWise cannot fully know.
- App-generated freshness timing is not a guarantee that food is safe or unsafe.
- You remain responsible for following package instructions, food safety guidance, allergy information, recall notices, and your own judgment.
- You should discard food that looks, smells, tastes, or seems unsafe, even if FridgeWise shows it as still fresh.
- You should not rely on FridgeWise for medical, allergy, pregnancy, infant-feeding, immunocompromised, or other high-risk dietary or safety decisions.
If you are unsure whether food is safe, do not consume it.
8. AI-generated and automated results
The Service may use AI, machine learning, rules, third-party product data, and automated systems to:
- Analyze receipts, grocery photos, and shopping lists.
- Classify grocery items.
- Suggest storage profiles or categories.
- Estimate freshness timing.
- Normalize product information.
Automated results may be incomplete, inaccurate, or inappropriate for your situation. You are responsible for reviewing and correcting items, dates, storages, quantities, and any other information before relying on them.
9. User content and inventory data
You may submit, upload, or store content through the Service, including grocery item names, quantities, storage locations, purchase dates, use-by dates, receipt photos, grocery photos, shopping lists, barcode/product data, feedback, and support messages ("User Content").
You retain ownership of your User Content. You grant TasteBot, LLC a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, analyze, transmit, and otherwise use your User Content as needed to provide, maintain, secure, improve, and support the Service.
You represent that you have the rights needed to provide User Content to the Service and that your User Content does not violate these Terms or applicable law.
10. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to violate the rights of others.
- Reverse engineer, scrape, overload, disrupt, or interfere with the Service.
- Attempt to bypass subscriptions, item limits, Smart Import limits, rate limits, cooldowns, or other usage safeguards.
- Upload malicious code, abusive content, or content you do not have the right to use.
- Use the Service to build a competing product or dataset without our permission.
- Misrepresent automated outputs as verified food safety advice.
We may suspend or terminate access if we reasonably believe you violated these Terms or used the Service in a harmful or abusive way.
11. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Service, you also agree to the Privacy Policy.
12. Third-party services and platforms
The Service may rely on third-party services and platforms, including Apple, Google, Supabase, OpenAI, Firebase, AppsFlyer, RevenueCat, Superwall, Sentry, and Open Food Facts.
Third-party services may have their own terms and privacy policies. We are not responsible for third-party services, data, outages, policies, or actions.
13. Intellectual property
The Service, including its software, design, branding, text, graphics, icons, and other content, is owned by TasteBot, LLC or its licensors and is protected by intellectual property laws.
These Terms do not grant you any ownership rights in the Service. You may use the Service only as permitted by these Terms.
14. Service availability and changes
We may modify, suspend, or discontinue all or part of the Service at any time. We may also impose or change limits on certain features.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.
15. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and safety.
We do not guarantee:
- That grocery information, barcode data, Smart Import results, or freshness estimates will be accurate.
- That notifications will arrive on time or at all.
- That food tracked in the Service is safe to consume.
- That the Service will prevent food waste, illness, allergic reactions, or other harm.
Some jurisdictions do not allow certain disclaimers, so some of these disclaimers may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, TasteBot, LLC and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, food spoilage, illness, injury, or other losses arising from or related to your use of the Service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:
- The amount you paid us for the Service in the 12 months before the claim arose; or
- USD $100.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
17. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless TasteBot, LLC and its owners, officers, employees, contractors, affiliates, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your use or misuse of the Service.
- Your User Content.
- Your violation of these Terms.
- Your violation of applicable law or third-party rights.
18. Dispute resolution; arbitration; class-action waiver
Before bringing a formal legal claim, you agree to first contact us at support@fridgewiseapp.com and attempt to resolve the dispute informally. We will do the same.
If a dispute is not resolved within 30 days, you and TasteBot, LLC agree to resolve any claim, dispute, or controversy arising out of or relating to the Service or these Terms by binding individual arbitration, except that either party may bring:
- An individual claim in small claims court if eligible.
- A claim for injunctive or equitable relief to protect intellectual property, security, or unauthorized use of the Service.
You and TasteBot, LLC agree that disputes will be resolved only on an individual basis and not as a class, consolidated, representative, or private attorney general action.
If any part of this arbitration agreement or class-action waiver is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
If you do not wish to be bound by this arbitration agreement, you must notify us by emailing support@fridgewiseapp.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. If you opt out, you will still be bound by the remaining provisions of these Terms.
19. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law principles.
Subject to the arbitration agreement above, courts located in Texas will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.
20. Account deletion and termination
You can delete your account through the app where available or by contacting us. When you delete your account, we delete your user record and associated active account and inventory data from our active systems, subject to backup, security, fraud-prevention, legal, and operational retention described in the Privacy Policy.
We may suspend or terminate your access to the Service if:
- You violate these Terms.
- We reasonably believe your use is harmful, fraudulent, abusive, or unlawful.
- We discontinue the Service or a material part of it.
21. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice, such as in-app notice or email, and indicate the new effective date.
Your continued use of the Service after updated Terms become effective means you accept the changes.
